Agreement to the terms of the agreement
1. Please read the instructions of this agreement carefully.
2. By actually installing the application, using the content found in it and/or the services provided in it and/or by marking "V" in the box at the bottom of the license agreement for the use of the application (hereinafter: "the agreement"), you confirm that you have been given the opportunity to review the terms of this agreement and you agree to all the terms detailed therein.
3. If you do not agree to any of the terms of the agreement, you are obligated, immediately, to remove and delete the application from the mobile device in your possession and may not make any use of the application, its content and/or services, in any way whatsoever.
License conditions
1. 2. The terms of the license do not transfer to you any right in or in connection with the application, but only a limited right to use it in accordance with the terms of the agreement.

1. Who is allowed to use the application
1. The use of the application and the services provided therein requires the creation of an account (hereinafter: "the account").
2. A user who wishes to create an account (both by himself and through his employer) (hereinafter: "the account owner") will be asked to provide certain details for the purpose of creating the account such as: phone number, payment method, size of ordered clothing and their models, e-mail, etc.
3. The information that will be provided when creating the account and the way in which Track Lease will use it are as detailed in the privacy policy.
4. After completing the account creation steps, Track Lease will send to one or more of the means of communication entered by the account holder a message confirming the creation of the account.
5. Login to the account will be done using a username and password.
6. The account will be available to the account holder and will include information about Track Lease's services that are provided to him in the account, including but not limited to: changing clothing, requests for repairs, selling clothing, etc.
7. It will be clarified that the account holder who provides the account users with the account's identification information (such as: identity number and credit card number) will be considered as giving permission for the account users to receive all the said information.
8. The user declares and undertakes that:
  1. will provide accurate and complete information, both during registration and any information that will be provided during the use of the company's services.   3. The account holder who allows use by an authorized user on his behalf, declares and undertakes that the user has read and approved the terms. An account holder who will add an additional phone number to his account that will be able to use the account is responsible for informing the owner of the phone number added to the account about what is stated in these terms of use and about the terms of Track Lease's services to which his account is attached, including but not limited to their rates and the relevant terms of use. In particular - the account owner undertakes to inform the user that information concerning the user's use of the services will be exposed at any time to the account owner and the account users who hold the account's identification details and/or have received other authorization on behalf of the account owner. The account holder will be responsible for any claim and/or claim and/or demand in this matter. If the account holder gains access to another, knowingly or unknowingly, Track Lease will not be responsible for the user's use of the account.
  4. The user is and will be at all times solely responsible for maintaining the confidentiality of account access details and is solely responsible for all operations that occur under the account and/or the application installed on the user's mobile device, including but not limited to unauthorized use.
  5. It will be clarified that if a device on which the application is installed and/or a device whose phone number is updated as a user with an account holder is transferred to a third party, who is not authorized to use the account, it is the sole responsibility of the user to log out of the user account to which he is associated before handing the device over to a third party and/or update the current phone number in his account and delete the transferred number and/or close the account and terminate the contract with Track Lease as detailed in these terms, otherwise the account holder will be charged a fee for the use through the account, and will not be entitled to receive a credit.
  6. For the avoidance of doubt, removing the application does not delete the user's contact information, and in order to delete it, the user must contact Track Lease's customer service center.
  7. The user undertakes to immediately contact Track Lease and notify of any discovery and/or unauthorized use and/or unauthorized intrusion and/or any update to the information provided through the account and to report to Track Lease immediately any event that resulted and/or may bring about unauthorized use of the application and/or account including but not limited to:
    1. loss of the cell phone device.
    2. Transferring the cell phone to a third party.
    3. The user must update Track Lease immediately in relation to each of the above-mentioned cases through an email message to the address office@track.lease or by phone number ___________. Given such notification, Track Lease will be entitled to close and/or suspend the account until the matter is settled. The user will attach relevant documents to the aforementioned request or report, if relevant.
    4. The account holder may not transfer and/or assign his rights in the account to another.
9. Track Lease reserves the right, at its sole discretion, to suspend or cancel the account and/or its services and/or refuse to provide the services, with or without prior notice, and this, among other things and not only if Track Lease has reasonable grounds to assume that the user , at any time, provided details that are not accurate and/or updated and/or complete and/or correct and/or acted without authorization and/or in cases where there would be a fear of violating the provisions of the agreement and/or the provisions of the law and/or considerations related to information security and/or or risk management.
Prohibited uses of the application
1. You may not (either by yourself or by someone on your behalf):
  1. Use the application, content and/or services for any illegal, immoral and/or unauthorized purpose and make any misuse and/or unreasonable use of it in relation to the purposes for which the application is intended.
  2. use the application, content and/or services for non-private commercial purposes, without Track Lease's express prior written consent.
  3. damage and/or disrupt the operation of the application and/or the servers and/or networks that store it.
  4. To bypass all the means used by Track Lease in order to protect the privacy of the users.
  5. Create a browser environment or frame or copy or deep link to any part of the Application, Content and/or Services without the express prior written permission of Track Lease.
  6. Create a database by systematically downloading and storing all or part of the content, among other things using automatic tools and technologies for scanning information, mining information and/or automatic retrieval or collection of information from within the application.
  7. Transfer or make available in any other way in connection with the application any virus, worm, Trojan horse, bug, spyware, malware or any other computer code, file, application, or software that may harm or is intended to harm the operation of the application.
  8. violate any of the terms of this agreement.
Access to the application
1. The application allows you to use its services immediately upon entering the application without having to identify yourself by re-entering the identification information in the application every time. You can disconnect from your account at the end of using the application, and in such a case you will have to enter the identification information again.
2. Track Lease may from time to time allow access to the application through different or additional means of identification and subject to conditions to be determined by it.
The Application, Content and Services

The content displayed in the online service is intended for general information purposes only, and it does not constitute an opinion, recommendation or offer to purchase or rent any service or product, and it does not come to replace the user's independent judgment in receiving professional advice.
Absence of representations, limitation, and exclusion of liability
1. Except as otherwise stated in this Agreement, Track Lease's application and services are provided "AS IS" and on an "AS AVAILABLE" basis, without any warranty of any kind, express or implied, including but not limited to, representations, commitment and adaptation to a specific purpose.
2. Track Lease does not guarantee that the application and/or the website and/or the company's services will operate without errors, interruptions, interruptions (temporary or permanent) or without viruses or other harmful codes or that they will be correct, complete or updated and/or that they will be immune from access illegal to its systems and/or that faults will be fixed.
3. Track Lease may change the services and/or cancel them partially and/or fully at any time, including but not limited to any other component of its services, without prior notice and/or retrospectively to the user.
4. The use of Track Lease's services is conditioned on the integrity of the cellular network to which the user's cellular telephone device belongs, who is solely responsible for the integrity and/or availability of all the services and components necessary for receiving Track Lease's services and which are provided to him by any third party, including but not limited to the integrity of the cellular network and its availability, the integrity of the necessary application components, the availability of content services, the existence of a GPS service and its activation, permission to receive text messages and more.
5. The user agrees that Track Lease will not be liable to him or to any third party for damages resulting from technical problems, including but not limited to, without limitation, in connection with the Internet or with all telecommunications and cellular network providers. Track Lease will not be responsible for delays in the provision of services as a result of events beyond its control, such as malfunctions, delays, strikes, natural disasters, malfunctions in the computer system or in the telephone systems that will harm the completion of the process of receiving and/or providing the services and/or malfunctions in the device and/or inconsistencies in relation to the settings and permissions entered by the user on the device and/or a malfunction in the systems of third parties including but not limited to authorities and/or parking lots and the like. The user undertakes that he will not have any plea, claim, or demand against Track Lease for the above. The use of Track Lease's services is the sole and full responsibility of the user.
6. To the extent that any of Track Lease's services and/or promotions and/or benefits are provided by an external service provider, Track Lease will not be held responsible for the level of service, the nature of the service, the integrity of the service and any other matter in connection with the service itself, which is not related to payment for The service only and the user must contact the service provider directly with any claim regarding the service provided, all as detailed in the relevant terms of service.
7. Track Lease and/or anyone on its behalf will not be responsible and will not bear any direct, indirect, consequential, punitive or special damage caused to the user and/or a third party, including but not limited to the equipment, as a result of using the services of Track Lease - whatever the cause of the claim - including and not limited to loss of income and/or prevention of profit caused by any reason, failure to save and/or backup and/or loss of content and/or any information in relation to the user and/or services, even if Track Lease has been notified of the possibility of such damages.
8. Without detracting from the above, Track Lease will not bear any responsibility and will not bear any damage, of any kind, direct and/or indirect, caused to the user and/or someone on his behalf resulting from the lack of ability to use the services of Track Lease which are offered to the user free of charge and/ or misrepresentation and/or inaccuracy and/or error and/or malfunction relating to said services. In relation to the services that are subject to the payment of service fees, the only remedy to which the user will be entitled for the inability to use the services is a refund of the amount of the service fees paid by him at the time when it was not possible to use that service, and subject to the fact that the lack of ability to use was due to an act and/ or default of Track Lease.
9. In any case, Track Lease's responsibility and liability towards the user will be limited solely to the direct financial damages that will actually be caused to the account holder and/or the user of the account, to the extent that they are caused, due to a malicious act or due to a fundamental violation of Track Lease's obligations according to the terms. This liability of Track Lease will be limited up to the amount paid by the account holder and/or the user of the Track Lease account and/or up to the amount for the services for which the account holder was billed for this.
10. The user is aware that Track Lease has agreed to contract with the user on the basis of this limitation of liability and that Track Lease relies on it.
Privacy Policy
1. Track Lease's privacy policy describes how the company collects, uses, stores and shares the user's information and is an integral part of these terms of use.
Rights and Intellectual Property
1. Track Lease's application, content and services and all related intellectual property rights, including but not limited to copyrights and trademarks (all together below: the "intellectual property") are owned by Track Lease and/or licensed to it and protected by Israeli and international intellectual property laws.
2. Any right not expressly granted to you under the terms of the Agreement shall be reserved by Track Lease and its licensors.
3. You may not copy, distribute, modify, or make a derivative work of any content subject to Track Lease's intellectual property rights, in any way or by any means, unless this is expressly permitted in the terms of the agreement and/or according to any applicable law.
4. No provision in the terms of this agreement constitutes a waiver of Track Lease's intellectual property under any law.
Availability of the Track Lease App, Content and Services
1. The temporality and functionality of Track Lease's application, content and services depend on many factors that are beyond Track Lease's control, including but not limited to software, hardware, communication networks, service providers or subcontractors of Track Lease or other third parties (including but not limited to those that provide storage services cloud and cellular services). Track Lease is not responsible for damages caused as a result of a disruption or malfunction that is beyond its control.
Information received from third parties
1. Certain information and data appearing in the Track Lease application and/or portal are obtained from third parties and provided to Track Lease by them or on their behalf. This information is provided to you as is (as is), without any obligation or warranty of any kind, express or implied, and is provided for general information only.
2. Also, you will be able to find various tools based on this information in the application and portal. This information is offered to you for convenience only, its use is solely your responsibility.
3. Track Lease does not guarantee that the information and data appearing in the application and received from any third parties and/or through their presentation will be accurate and/or error-free, Track Lease does not guarantee the correctness or reliability of this information and data.
Risks related to the cellular network and the Internet
1. Track Lease invests a lot of effort in protecting against risks inherent in the internet and mobile network, as far as the protection against them is in its hands. However, it is not within Track Lease's ability and/or control to completely prevent the penetration and operation of harmful software and hostile factors such as: viruses, worms, Trojan horses, bugs, spies, harmful or any other computer codes, files or software that may harm your privacy, Eavesdrop on network traffic, break into Track Lease's databases, servers or computers, impersonate the application or Track Lease, commit scams and online frauds, damage or sabotage the operation of the application, content and/or services of Track Lease.
Changes to the application and the terms of the agreement
1. Track Lease may, from time to time, make changes to the application, including but not limited to extensions, deletions, improvements, adjustments, and any other changes as well as updating the terms of the agreement, the terms of use of the portal and the privacy policy. Track Lease will notify you of material changes in the manner you determine (including but not limited to a notification on the home screen of the application and/or portal, as the case may be), subject to all laws. Your continued use of the Track Lease application, content and/or services will indicate your agreement and acceptance of the updated terms of the agreement.
2. If you do not agree to the updated terms of the agreement, you must refrain from continuing to use the application, content and/or services of Track Lease, close your account and remove the application.
Special conditions relating to third-party components
1. The Application may use or include software, files, hardware and/or components subject to license terms including but not limited to open-source licenses of third parties ("Third Party Components"). You may use third-party components as part of, or in connection with, the application solely subject to your compliance with the license conditions applicable and/or accompanying the relevant third-party components. In the event of a conflict between the license terms of a third-party component and these terms, the license terms of the relevant third-party component will prevail with respect to such third-party components only. These terms do not apply to any third-party components accompanying and/or included in the application Track Lease disclaims any liability related thereto.
2. You acknowledge that Track Lease is not the creator, owner or licensor of third-party components, Track Lease makes no representation or warranty of any kind, express or implied, regarding the quality, capabilities, operation, performance, or suitability of this third-party component or Other.
Indemnification
1. The user undertakes to compensate and/or indemnify Track Lease, its managers, employees, representatives, shareholders, and all those acting on its behalf and/or for it and any other party related to the provision of its services, immediately upon their first demand, for any claim and/or damage and/or injury and/or loss and/or expense incurred by them, of any kind and type, including but not limited to attorney's fees and reasonable legal expenses, due to a violation of these terms and/or the provisions of the law by the user, as well as due to any claim and/or demand and/ or a claim brought against them by any third party, for such violation. For the avoidance of doubt, it is clarified that this indemnification clause does not detract from additional restaurants granted Track Lease according to any law.
General
1. These terms of use are written in the masculine language for convenience only, but they are intended for both males and females.
2. There is nothing in the terms of this agreement to detract from any other agreement between Track Lease and you and/or to change it.
3. Any delay by Track Lease in maintaining a right it is entitled to or its failure to comply with a right it is entitled to according to the terms of use or by law, is a matter of law only and shall not be considered a waiver by Track Lease of such right.
4. Track Lease may transfer and/or delegate, at any time, its rights, and obligations towards the user to a third party without giving any notice.
5. These terms of use shall be exclusively governed by the laws of the State of Israel.
6. The exclusive place of jurisdiction in all matters relating to these terms of use and the use of Track Lease's services are the competent courts in the Tel Aviv-Jaffa area, Israel only.
7. The terms of the agreement do not create and will not be interpreted as if they create a partnership relationship, a joint venture, an employee-employer relationship, a mission relationship or a grantor-receiver franchise relationship between the parties.
8. Any provision of the provisions of this agreement which is found to be invalid or illegal or unenforceable will not affect the applicability or validity of the other provisions of this agreement.
